01Article 1 (Scope)

These Terms are intended to define the rights and obligations between you and us regarding the provision and use of the App, and apply to every relationship between you and us concerning the use of the App.

02Article 2 (Use)

• The App is provided for recording, viewing, and analyzing swimming times and related data.
• You use the App at your own responsibility.
• You are responsible for preparing, at your own expense, the device and communication environment required to use the App.

03Article 3 (Record data)

Record data and photos entered and saved in the App are, in principle, stored on your device. They are not transmitted to any server operated by us, and we do not collect or view their contents.

04Article 4 (Subscription)

• The App offers a monthly auto-renewing subscription (Premium) that removes ads.
• Pricing and contents follow the information shown on the App Store.
• Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription renews automatically and is charged to the payment method linked to your Apple ID.
• You can cancel (turn off auto-renewal) yourself from “Settings > Apple ID > Subscriptions” on iOS.
• You can restore purchases from “Restore Purchases” within the App.
• Refunds follow Apple (App Store) policy. As we do not process payments, we generally cannot handle individual refund requests.

05Article 5 (Advertising)

To keep the App free, it displays advertising (Google AdMob). For how advertising and tracking are handled, please see the Privacy Policy. No ads are shown while you are subscribed to Premium.

06Article 6 (Prohibited conduct)

When using the App, you must not engage in any of the following:

• Acts that violate laws or public order and morals
• Copying, modifying, reverse engineering, or decompiling the App
• Exploiting defects in the App to obtain features improperly
• Infringing the intellectual property or other rights of us or third parties
• Interfering with, or risking interference with, the operation of the App

07Article 7 (Intellectual property)

Intellectual property rights in the App and its related programs, design, trademarks, and the like belong to us or the rightful holders. Rights in the record data you enter belong to you.

08Article 8 (Disclaimer)

• We do not warrant that the App fits your particular purpose, or the accuracy or completeness of records or calculation results.
• We are not liable for any damages arising from your use of, or inability to use, the App (including loss of data).
• We are not liable for damages arising from third-party services (such as advertising or billing).
• Even where we are liable, except in cases of our willful misconduct or gross negligence, our liability is limited to the amount you paid for the App in the one month immediately preceding the occurrence of the damage.

09Article 9 (Changes and termination of the App)

We may change the contents of the App, or suspend or terminate its provision, without prior notice to you. We are not liable for any damages arising to you as a result.

10Article 10 (Changes to these Terms)

We may change these Terms when we deem it necessary. The revised Terms take effect once posted on this page, and if you continue to use the App after the change, you are deemed to have agreed to the revised Terms.

11Article 11 (Governing law and jurisdiction)

The interpretation and application of these Terms are governed by the laws of Japan. In the event of a dispute regarding the App, the court having jurisdiction over our location shall have exclusive agreed jurisdiction in the first instance.
